"Eugene School Board Chairman Jim Torrey said in a statement Wednesday that “now it is time to move forward” and use the revelation of board members’ secret efforts to negotiate an exit plan with Superintendent Sheldon Berman as an “opportunity to reinforce our respect for consistently open and candid board discussions of school district business.”
Torrey’s statement does not specifically defend or repudiate board members’ efforts to shield their concerns about Berman’s job performance, or address newly released emails’ suggestion that some board members may have violated Oregon’s public record and public meetings laws.
The unredacted emails, inadvertently released to The Register-Guard, show that board members negotiated a settlement plan that would allow Berman to avoid a negative job performance review, which one board member said could have led to his firing.
The emails further reveal that some board members avoided meeting publicly or even in closed-door sessions to talk about Berman. Instead, they communicated with each other on private email accounts, text messages and over the phone.
Board member Beth Gerot said she planned to shred any documents she had regarding Berman’s performance evaluation. State public records law prohibits elected officials from destroying public documents.
“As experienced public officials, we have a deep and abiding respect for Oregon’s public records and public meetings laws,” Torrey said in his statement. “The school district’s disagreement with The Register-Guard on disclosure of a limited number of records was on its way to a proposed settlement when documents at issue were mistakenly sent to the newspaper’s legal counsel by the district’s lawyer. Mistakes happen.”
Berman, meanwhile, said in a statement of his own, also released Wednesday, that he is concerned that the newspaper article may damage the community’s perspective on “the district and the board, as well as me personally.”
“The emails were sent during a time that was particularly challenging for the district, the board and me,” Berman said in his emailed statement. “The year since has been a much more positive and productive time. I think it’s fair to say that the quoted emails and the article don’t begin to describe or reflect the many accomplishments we have achieved.”
Berman added that he has “worked diligently to address concerns raised in my discussions with board members last year.”
“My reasons for leaving Eugene remain largely personal and family ones,” Berman said.
Gustavo Balderas, who will succeed Berman in July, declined to comment Wednesday.
Eugene Education Association teachers union President Tad Shannon said teachers feel that the board’s responsiveness to teacher concerns has improved in the past year, but teachers did not notice a change in Berman’s performance.
“Shelley (Berman) actually thinks he’s a collaborator and a listener,” Shannon said. “Unfortunately, most staff don’t see it that way.”
Shannon didn’t comment specifically on the board’s decision to try to hide its negotiations with Berman.
“Ultimately, the result was something that the staff agrees with,” Shannon said of Berman leaving at the end of this school year.
“There was frustration regarding the time it took for teachers to feel listened to and for the board to take action,” said Shannon, adding that he didn’t want to “second-guess the board.”
$21,246 in district legal fees
The school district earlier this year sued The Register-Guard to avoid disclosing 12 pages of records that the Lane County District Attorney’s Office ordered the district to release. Last week, the Harrang Long Gary Rudnick P.C. law firm sent the newspaper unredacted copies of emails that the newspaper requested last year, including those that were at issue in the lawsuit.
Torrey on Wednesday did not immediately respond to a request for comment about the status of the lawsuit.
The newspaper’s general counsel, Wendy Baker, said the lawsuit is moot. She said the next step should be a stipulated judgment of dismissal of the lawsuit.
As of last month, the district had spent $21,246 in legal fees to Harrang Long regarding the newspaper’s records request and the district’s subsequent lawsuit against the paper.
In his statement Wednesday, Berman said he was asked to “implement significant changes and improve student performance while implementing dramatic budget reductions and bringing consistency and coherence to a largely site-based system” when he came to Eugene in 2011.
“These changes were not easy, nor were they always popular,” Berman said. “However, I believe that they are serving students well and will continue to do so in the long term.”
Berman also referenced a letter written by Torrey and presented at a school board retreat earlier this month. In the letter, Torrey thanked Berman for his work in the district, particularly for his efforts to improve the district’s instruction, communication, graduation rates and passage of a 2013 bond measure.
“Shelley has brought great strengths and insights to this district,” Torrey said. “His leadership has been invaluable in a challenging time and in this transition year.”
In its negotiations with Berman about his departure, the school board was advised by an attorney to provide a letter of reference highlighting Berman’s positive contributions to the district, email records indicate.
Roscoe Caron, a retired Eugene middle school teacher and now an adjunct professor at the University of Oregon, has been critical for several years of what he describes as the centralization of the district under Berman’s tenure.
Caron said Wednesday that he believes the school board erred in hiring Berman. He criticized board members for not terminating him.
“The secret negotiations for an exit plan were not designed to shield Berman,” Caron said. “They were designed to shield the board from having to account for their initial hiring decision and for the litany of unpopular decisions and attitudes that followed.”

Bill Gary, Sharon Rudnick, and Randy Geller of UO’s HLGR law firm must be shitting their pants. I’m no lawyer, but sending a dump of emails that potentially incriminate your clients to the local newspaper, by mistake, seems unlikely to bring in the billable hours.

Eugene School Board members allowed Superintendent Sheldon Berman to come up with his own exit plan to avoid the release of a negative performance review, which one board member said could result in his firing, newly obtained records show.
Board members also said in emails last year that if they couldn’t successfully negotiate a departure agreement with Berman, they planned to make his evaluation public and hire an investigator to look into unspecified actions by Berman.
Further, emails between board members show that some members went to great lengths to avoid meeting publicly or even in a closed-door session, in potential violation of state public meetings law. Other emails show that one board member — Beth Gerot — said she would destroy some public records related to Berman’s evaluation. It is a violation of state law for a public official to destroy public records.
The new information is contained in records that the law firm representing the Eugene School District inadvertently sent to The Register-Guard. The district contends the records should be kept secret, but the newspaper’s general counsel, Wendy Baker, said the district has “no legitimate basis” for keeping the records secret, and that the newspaper is publishing them because “elected officials should be held accountable to their constituents and their community.”
The school district sued The Register-Guard in Lane County Circuit Court earlier this year to avoid disclosing 12 pages of records that the Lane County District Attorney’s Office ruled it must release. The district hired the Eugene law firm of Harrang Long Gary Rudnick P.C. to represent it in its lawsuit.
In the course of legal proceedings, the law firm last week sent the newspaper hundreds of unredacted emails regarding Berman’s job performance that The Register-Guard requested last year…
Wendy Baker makes me feel like a wimp for giving the UO president’s digital archives back to Bill Gary. With any luck, HLGR’s next mistake will be to mail that “zip drive” to Rich Read at the Oregonian, 1500 SW First Avenue, Portland, OR 97201.
But wait, there’s more, as a commenter points out. The documents potential implicate HLGR lawyer and former UO General Counsel Randy Geller’s wife (and school board member) Jennifer Geller in a conspiracy to break Oregon’s open meetings law:
Walston sent Geller a text message on March 7, 2014, that read: “Jennifer, I know (there) was talk of an (executive, closed-door) session to discuss Shelley’s performance as a last item on Monday. I talked with (then-district chief of staff) Barb (Bellamy) and Craig (Smith) yesterday and we cannot see how we could have — at this point in time — the discussion we seem to want — under (Oregon Revised Statutes) exemption. Craig talked to Shelley — at Shelley’s request after last week’s review. Craig suggested Shelley call individual board members for feedback. The hope is that Shelley will listen and be able to count to 4,” referring to a board majority that could effectively end his employment.
According to the emails, Walston said she would sequentially telephone each individual board member to update them on the process of evaluating Berman. It is a violation of Oregon public meetings law for public officials to hold sequential private one-on-one discussions with a board majority in order to deliberate toward a decision, an Oregon Circuit Court judge ruled in 2011.
Gerot wrote to all board members on March 9, 2014, that the district’s consultant, Lewis, would meet with her, in addition to board members Alicia Hays and Geller, to “communicate verbally and without attribution” what the consultant learned through her interviews with district employees.

We like to think of college as a wonderful time of growth and learning. The reality in Oregon, however, is that college can be a very dangerous period for too many young women.
Recent events have given our students a good reason to worry that when they have been sexually assaulted and want to have the benefit of victims’ support and counseling services, they cannot trust their college to protect their privacy. That is because Oregon is one of only 10 states without confidentiality protections for victims seeking services from domestic violence or sexual assault advocates.
It is time for Oregon to step forward and ensure the privacy of victims’ communications and records. We know that many students who have been sexually assaulted are choosing not to seek critically needed help. Studies indicate that the primary reason victims of sexual assault do not come forward is that they fear disclosure of extremely private and potentially embarrassing information — without their consent. All too often, this fear is justified.
Without specialized services, a victim’s path to recovery is rocky. The feelings of shame and humiliation that arise in the aftermath of an assault can be debilitating and life-altering.
This leaves victims on campus with an awful dilemma: seek help and advocacy services, triggering an intimidating and invasive administrative process — or suffer alone. This is because many colleges and universities interpret federal law (also known as Title IX) to require investigation of all disclosures of assault, regardless of the victim’s consent. However, in the 40 states that have passed laws providing for confidentiality, private statements and records cannot be disclosed unless the victim has given her consent.
We owe it to our daughters and sons to remedy this unacceptable situation. That is why we are coming together, as a coalition of bipartisan legislators, educators, students, advocates and law enforcement to introduce legislation to address this problem. This week, the Oregon House Judiciary committee heard testimony on House Bill 3476, a bill that will ensure that victims may access services providing support and advocacy, without fear of disclosure.
A victim’s journey is difficult, and we should do everything we can to ease the transition from victim to survivor.
Addressing the problem of sexual violence on our campuses will take hard work and commitment. Our first step to recovery is to close this loophole. Please join us in urging the Oregon Legislature to pass this important piece of legislation.
