(BALTIMORE, MD, 2/27/20) – The Council on American-Islamic Relations (CAIR) is calling for judicial oversight of U.S. Immigration and Customs Enforcement’s (ICE) access to Maryland drivers’ records after reports surfaced today that the federal agency was able to bypass state and court approval to access millions of Maryland driver’s license photos and use biometric scanning technology to run facial-recognition searches.

Earlier today, the civil rights organization submitted testimony in support of House Bill 892/Senate Bill 649 – Motor Vehicle Administration – Warrant for Personal Information and Reporting, introduced in the State Senate by Senator Clarence Lam et al, and in the House by Delegate Dana Stein et al.
CAIR’s testimony read in part:
“The prospect of the Trump administration using biometric technology unchecked to aggressively supercharge its deportation machine is deeply concerning. The technology enables ICE officials to run a photograph of any unknown individual through its system without a warrant or any reasonable cause, and determine whether potentially undocumented immigrants are returned as a match.
“Our organization supports HB892/SB649 because this measure would help restore trust, protect Marylanders from misuse of their sensitive and private information, and provide critical oversight by requiring federal immigration enforcement agencies like ICE to first obtain a warrant and authorization from a judge in order to access personal information from the MVA.”

CAIR-Georgia Appoints Attorney Murtaza Khwaja as Legal and Policy Director
(ATLANTA, GA – 2/24/2020) -- The Georgia chapter of the Council on American-Islamic Relations (CAIR-Georgia), the nation's largest Muslim civil rights and advocacy organization, today announced that it has appointed attorney Murtaza Khwaja to serve as its Legal and Policy Director.
Khwaja previously served as CAIR-Georgia's staff attorney and lobbyist from 2017 to 2020. In his new role, Khwaja manages--and oversees the expansion of--the civil rights organization's legal and policy departments, which are pursuing creative legal and grassroots advocacy solutions to address discrimination and bigotry in Georgia.
"Murtaza Khwaja is a talented and dedicated lawyer who has successfully represented numerous Georgians impacted by bigotry and discrimination, even as he simultaneously advocates for justice in the halls of our state legislature," said Edward Ahmed Mitchell, the outgoing executive director of CAIR-Georgia. “His skills and experiences make him uniquely positioned to strengthen and expand our legal department as we work to serve many more clients around the state.”
Khwaja joined CAIR Georgia as its staff attorney and lobbyist from 2017. In that capacity, he represented numerous victims of anti-Muslim discrimination, helped defeat anti-immigrant bills at the Georgia state legislature, and led efforts to organize the first-ever Muslim Advocacy Day at the Georgia State Capitol.
During law school, Khwaja interned with the International Center for Advocates Against Discrimination and spent a year working in the Capital Defenders Clinic, where he helped Georgia Capital Defender attorneys argue against the death penalty.
As a member of the Muslim Law Students Association at the GSU College of Law, Khwaja co-founded the Glitter of Hope Legal Clinic. The clinic aimed to provide legal assistance and resources to the Clarkston refugee community, including Know Your Rights workshops.
“I’m grateful for the opportunity to serve the Georgia Muslim community and the entire Georgia community as CAIR-Georgia’s Legal and Policy Director,” said Khwaja. “I look forward to advancing our work with our coalition and community partners to promote, defend and advocate for the civil rights of all Georgians, whether in the courtroom, in our state legislature or in our homes. CAIR Joins Coalition Partners to Testify in Support of Maryland Bill to Protect Minors’ Rights
(BALTIMORE, MD, 2/24/20) – The Council on American-Islamic Relations (CAIR) announced today that it joined BRIDGE Maryland, Leaders of a Beautiful Struggle, the ACLU of Maryland and other community partners to testify in support of a bill in both the Maryland House of Delegates and State Senate designed to protect minors’ rights when they are taken into law enforcement custody.
The proposed law would require officers to first provide notice to their parent or guardian and ensure that they have the opportunity to confidentially consult with their attorney.

Efforts to introduce the legislation were galvanized partly by accounts of false testimonies similar to those that led to the wrongful sentencing and conviction of the Central Park Five - five teens featured in Ava Duvernay’s four-part Netflix drama series ‘When They See Us’ who were rounded up in 1989 and convicted in the assault and rape of a white woman in New York after being compelled to make false confessions while in police custody.

CAIR’s testimony reads in part:
“The Juvenile Justice System was established nearly a century ago with the goal of diverting youth offenders from the destructive punishments of criminal courts and encouraging rehabilitation based on their individual needs.
“We have a separate criminal justice system for juveniles with good reason, and it stands to reason that we should have protections for minors in the instance of an interrogation in order to protect their rights.
“Furthermore, juveniles are less likely to understand the legal process or what rights they possess. Research shows that minors are more likely to comply with authority from a place of fear, and to feel pressured to give a false confession.
“In one study of youth who self-reported confessing, 36% reported that they gave a false confession. These are the circumstances facing young people who either don’t know or don't feel empowered to assert their rights, and we need more lawmakers to join the fight to legislate change in Maryland. In order to set the tone for justice, rather than prioritizing speedy interrogations and fast-tracking false confessions, law enforcement should prioritize accurate, ethical and fair interrogations instead.
“A false confession leads an innocent juvenile straight into the criminal justice system and permanently alters the trajectory of their and their loved ones’ lives, and it drastically diminishes their prospects for a vibrant future.”
