DR. MARSHALL SUMMAR: Well, that’s actually a great question, because, historically, they didn’t. They stayed away from the rare disease field. They figured there weren’t that many patients. There wasn’t much market. …

Greg Bolt of the RG will tell you that Pat Kilkenny has been working for UO without a written contract, just like Bellotti did. Not a surprise at this point. But why did Dave Frohnmayer ever put Kilkenny in charge of the UO athletics department, and let him decide how many millions of dollars – most of it public money, or tax deductible gifts – would be spent how, and on which coach?
These things are very complicated and involve lots of mutual respect and consideration of the public interest are usually about money.
Frohnmayer received $200,000 per year in pay from donors to the UO Foundation, and a special $150,000 bonus in 2009. These payments to Frohnmayer amounted to about 3% of the entire payout from the UO endowment that year.  Who gave this money? What were the terms of the gifts? The Oregon Attorney General has ruled that the UO Foundation can keep this a secret.
But the IRS has released the data on donations from Pat Kilkenny’s “Lucky Duck Foundation” to Dave Frohnmayer’s Fanconi Foundation. Courtesy of the IRS and www.guidestar.org. Kilkenny gave $240,000 the year before Frohnmayer appointed him as Athletic Director, and another $100,000 each year since.
This is a sad story for everyone involved, in just about every possible sense. And no one would argue that Frohnmayer benefited financially from these donations to the Fanconi Foundation. But they create an obvious potential for a conflict of interest. Frohnmayer should have immediately made them public, and recused himself from any decisions involving Pat Kilkenny. Instead he kept quiet and then appointed him UO Athletic Director and gave him control of a budget of about $60 millon, mostly public funds. Not good, Mr. Frohnmayer.

"This is apparently stirring up a lot of anger among some professors. I’m not sure why, obviously this is just a small part of what we do but it is a part.
I did these calculations a while ago for President Emeritus Frohnmayer, on the argument that people should know exactly how much his golden parachute costs the rest of the faculty. I got some angry comments – presumably from Frohnmayer – on that post. Then this summer, I asked to see his current year contract. He hadn’t signed one, but he was still getting paid – in summer. That raised a few red flags, and Russ Tomlin quickly put him on the regular TRP retirement plan, cutting his cost to UO by about $200,000 a year. The power of information.

Ted Kulongoski asked Kroger to investigate the arrangement, Long declined to be interviewed. Two other Energy employees, however, told Sean Riddell, the deputy AG leading the investigation, that Long called attention to Hayes' relationship with Kitzhaber, who was poised to run for governor, and ordered one of them to "fix it."
No one should be surprised that Long is sensitive to issues of power and influence.
He is the son of Stan Long, a long-time friend and associate of former AG Dave Frohnmayer, and a founding partner of the law firm Harrang Long Gary Rudnick.  
Harrang Long is rather well-connected, especially when it comes to Oregon's Department of Justice.
Not only is Frohnmayer in the fold, but the firm's roster includes two former Solicitor Generals, Bill Gary and Jim Mountain, and Pete Shepherd, DOJ's second-in-command from 2001-2009.
They know how Justice works. Or how it long has.
Gary is equipped with the tenacity that would give a pitbull pause. He is the rare litigator who has represented both Oregon Health Sciences University and Philip Morris, the tobacco company that has long provided OHSU with so many customers."

3/29/2013: OUS’s Oregon Administrative Rule 580 exempts a few things from the normal transparent competitive bidding process for state procurement:
(k) Goods or services related to intercollegiate athletic programs.
(L) Cadavers or cadaveric organs.
…
(u) Contracts for professional or expert witnesses or consultants to provide services or testimony relating to existing or potential litigation or legal matters in which an Institution is or may become interested.
At its April 5 meeting the board is going to amend that a little, adding all legal services to the list, so that UO can hire firms like Rudnick and Frohnmayer’s HLGR in secret, and without competitive bids:
I’ve written before about Dave Frohnmayer’s success at using his state funded sabbatical to restart his legal career at Harrang, Long, Gary and Rudnick. (Full disclosure: Frohnmayer emailed me back in January, taking umbrage with some of my statements about the golden parachute deal he negotiated with Pernsteiner while simultaneously trying convince the faculty and staff to take furloughs.) HLGR then used Frohnmayer’s UO connections as a hook to get legal work from UO and OUS, while simultaneously promising there was no conflict of interest – thought they neglected to note Frohnmayer was still on the UO payroll. It took a petition to the AG and the help of Phil Barhart’s office to get UO to fork over the proposals. I love that “and at your discretion” part of the HLGR proposal:

How rare is Frohnmayer’s sweet retirement deal?


8/14/2009: We’ve reported before on Frohnmayer’s amazing retirement contract. The OUS board created a new position for him, called “President Emeritus”. He keeps his $245,000 base salary plus whatever the Foundation gives him to top it off, (currently $50K as Knight chair) plus a secretary and a GTF, plus a full salary 1/2 year sabbatical, plus a 90% salary 2 month “study leave”, plus offices in the HC and the law school, plus expenses including travel. In return he agrees to teach one 20 person class per year. Furthermore, when he decides to really retire, UO still won’t be done shelling out the bucks – he will be eligible for the same golden parachute contract that he gave to his former Provost, John Moseley.
Frohnmayer’s retirement package is unusually generous even in the sycophantic world of university boards and administrators. For example, Insidehighered.com has a story on a renegotiation of the retirement contract for retired NC State Chancellor (President) James Oblinger. He was originally allowed to keep his Chancellor’s salary for 6 months, before going back to a regular faculty member’s pay (and duties!). If we read Dave’s contract correctly, his deal is good for as long as he wants it. I’m guessing that will be a really, really long time. Page one says “Further, at all times, Frohnmayer shall enjoy the privileges associated with serving as a tenured professor at the University of Oregon School of Law.” But the contract says absolutely nothing about any of the responsibilities. He can teach a class in the law school someday – if he chooses to do so.

7/20/2011: When UO President Dave Frohnmayer retired he negotiated a very sweet retirement deal with OUS Chancellor George Pernsteiner. Too sweet. A week after someone raised questions about the unusual salary Frohnmayer received last summer – no work expectations and 3 retroactive contracts – Frohnmayer had to write UO out a personal check, reimbursing us for a chunk of it. The SOS Audits division looked into this and wrote a report identifying some other issues as well.
He’s no longer on the UO payroll. I don’t think I’ll post the report. I suppose the photocopy of his check is a public record, but whatever. He is still listed as a law professor – helps get clients, I suppose – and he still has his office suite in Chapman. But he paid us back, and he’s off the payroll – good enough for me.

"What exactly does it take to lose the faith of the American Academy of Arts and Sciences? 
For a couple of weeks now, the Cambridge institution has been under siege amid allegations that its longtime president, Leslie Cohen Berlowitz, has committed a litany of offenses, the major one being claiming a doctorate from New York University that she never earned. 

Berlowitz was placed on paid leave from her $598,000-a-year job while her tenure is being investigated by the law firm of Choate, Hall and Stewart. They keep getting more to look into: The latest report by the Globe’s Todd Wallack indicates that she was made a fellow of the academy under curious circumstances, which were covered by rewriting a months-old press release.

Her response? Sexism:

“Neither the academy nor President Berlowitz is going to respond to subjective, interpretive, and gossipy allegations from former employees and unnamed sources,” Howell said in the statement. “Nor are they going to respond to personal questions that are irrelevant, do not belong in the public domain and, frankly, smack of sexism.”

12/26/2013 update: Dave Frohnmayer and Barbara West will also co-teach a 199 Political Science course, “Theories of Leadership”.Experimental 199 classes are supposed to be reviewed and approved by the faculty Senate after 2 years. Frohnmayer and West, who is his former special assistant and holds a PhD in Jungian Psychology, have taught this for many years, with no review or approval.

12/23/2013: Reports are mixed. By UO’s normal tenure reduction rules he should now just be a retired emeritus. And in fact UO’s most recent payroll report lists his regular law professor appointment as having been terminated as of August 15, and his current title and job status as “emeritus”.

Why Dave Frohnmayer is not an acceptable interim President

"Here is Frohnmayer’s 2009 golden parachute sabbatical contract, negotiated with his pal George Pernsteiner. It took me three months and two petitions to the DOJ to force OUS lawyer Ryan Hagemann to produce this contract. It’s not hard to see why. Here’s a video clip of Frohnmayer trying to convince the UO faculty to go along with Pernsteiner’s plan for “voluntary furloughs.”
This was right after Pernsteiner had given Frohnmayer a $150,000 bonus, and taken a raise for himself – which OUS spokesperson Di Saunders then tried to hide from the Oregonian, just as they’d tried to hide Frohnmayer’s previous raises, and who paid for them.
Frohnmayer spent his sabbatical restarting his legal career, not doing the research he claimed he would do. Here’s the state audits division investigation report. He had to write a check refunding UO money.
He was paid for retroactive summer contracts Russ Tomlin set up for him, after the lack of written contracts had been reported. Shades of Mike Bellotti.
Frohnmayer never accepted responsibility for Bellotti, but blamed it all on his scapegoat, Melinda Grier. That’s leadership for you.
He appointed Pat Kilkenny AD, after Kilkenny started making large donations to his Fanconi Foundation. Two weeks before stepping down as President he signed a secret deal with Kilkenny, giving the athletic department half off on overhead and requiring the academic side to pay them $375,000 for using the Autzen skybox.
No more of Frohnmayer’s old guard. No more Frohnmayer. Unacceptable.

Frohnmayer was waiting to see exactly how much the AG's report unearthed before he went on the record with his version. And the report has just one mention of Frohnmayer - he delegated signing authority to Grier - and none of the $440,000 in donations from Pat Kilkenny, before and after Frohnmayer appointed Kilkenny AD and let him negotiate the Bellotti deal. This is a professional courtesy from the new AG to the old one. Neither wants anything in the papers that makes the office of Attorney General look bad.


So, now that the Oregon DOJ and the investigator David Leith have let Dave Frohnmayer off the hook, he shoves Melinda Grier under the bus:
“I assumed the contracts would be handled in due course,” he said.
“I think I reasonably relied on the usual course of business being followed by the general counsel’s office.”

“I wasn’t always happy with how the relationship worked,” he said.
“Even with direct reporting, I felt I wasn’t always getting direct reports.”

The attorney general’s report also was critical of Grier, saying she gave the university “deficient legal representation” and failed to report problems with Bellotti contract issues to the justice department.
Frohnmayer declined to comment on those issues but defended Grier’s dedication to the university.
“Melinda is a very hard-working person,” he said.
“I don’t know anyone whose car was in the parking lot on weekends and holidays more than Melinda Grier’s. There was no lacking of energy and devotion to her job.”
Nice job reference, Dave: "Ms Grier served as my loyal General Counsel for 12 years, covering my ass even when this led the Oregon Bar to start an ethics investigation of her. But in the end it turned out she was incompetent, made me look like a fool in the press, provided deficient legal representation and had to put in a lot of hours to accomplish even that. However, I did find her to be an excellent scapegoat."

"In the essay -- titled "Misplaced priorities? Follow the money" -- Harbaugh hit on some familiar themes, noting that while many things are in decline at UO, the compensation package of university President Dave Frohnmayer is not.
If money is tight in the Oregon University System, Harbaugh wrote, the OUS Board "has somehow found the cash to increase UO President Frohnmayer's pay by 325 percent." He pegged Frohnmayer's total compensation at $717,000 ...
...And that prompted a revealing response from Ryan Hagemann, secretary of the State Board of Higher Ed.
Hagemann wrote to The Oregonian, arguing that Harbaugh's numbers were wrong. He argued that Frohnmayer received a state salary of $245,700 and additional compensation from the UO Foundation of $199,260, putting his annual pay at$444,960.
"As such," Hagemann's letter states, "Mr. Frohnmayer's total state and privately funded annual pre-tax salary combined is $444,960, not the inflated number of $700,000 as cited by Mr. Harbaugh. lf Oregonians are interested in comparing university presidents nationwide, The Chronicle of Higher Education completes an annual survey which is available on their website."

"The prominent public figure who loses his way has become a staple of the last decade. Perhaps it is because we know more about our public figures. Perhaps it’s because their careers are running longer. Perhaps it’s because temptation looms larger these days.
#Dave Frohnmayer is the latest Oregon politician to surprise us. Willamette Week reported last week that Oregon’s former attorney general was compensated by tobacco companies to be their witness in their case arguing they should pay less to the state of Oregon. To anyone familiar with Frohnmayer’s history over the past three decades, this news prompted a double-take and a response of “Huh?”
#WW described Frohnmayer as “the star witness and paid expert for Big Tobacco against the state of Oregon.” It happened during a closed arbitration panel in Chicago. The newspaper obtained Frohnmayer’s testimony through a public records request to the state Department of Justice. It reported that Frohnmayer assisted “tobacco firms trying to get out of making payments to the state of Oregon under the tobacco settlement reached more than a decade ago.”

6/15/2012 update: I’m no legal ethics professor, but this doesn’t look good for Frohnmayer:
The full letter is here. The Bar’s disciplinary counsel has given Frohnmayer and Gary until 6/21 to respond. The Bend Bulletin reportsthat the county has spent about $100,000 on the matter so far, presumably much of it to Frohnmayer and Gary’s firm. 4/21/2012: I’m pretty sure this will only interest my law school readers, at best, but I thought I’d post this Oregon State Bar ethics complaint, filed in March by Valerie Wright against Frohnmayer, Bill Gary, and Deschutes County Counsel Mark Pilliod for the record. It’s a twisted story. The Bend Bulletin has a helpful timeline.

Wright is a lawyer and the wife of Deschutes County DA Patrick Flaherty. From what I can tell Deschutes county hired our former Pres at $550 an hour last year to help Pilliod and the county commissioners with a Bar ethics complaint they were supporting against Flaherty, who had opened a grand jury investigation against Pilliod involving a relatively trivial sounding violation of public records law – or maybe I’m jaded. Or maybe this all goes back to Flaherty defeating the commissioner’s favorite longtime DA in an election.
Wright alleges that in the course of pursuing the ethics complaint against her husband Frohnmayer and Gary and Pilliod made some false statements to the bar, so she’s filing this ethics complaint against them:
