A landscaper allegedly injured two years ago when a car rolled down the driveway and struck her at the University of Oregon president’s residence has filed a $61,000 lawsuit against UO President Dave Frohnmayer and the owners of the vehicle.
In a lawsuit filed last week, Loretta Jane Brubaker said she was planting flowers along the driveway at the UO-owned house when she was struck by an unoccupied BMW convertible owned by Marcia Baldwin and Mira Frohnmayer, the university president’s sister.
Brubaker charged that Baldwin and Mira Frohnmayer were negligent in failing to turn the car’s front wheels toward the curb and effectively set its parking brake when they left the BMW parked on the inclined driveway in the 2300 block of McMorran Drive. Brubaker said Dave Frohnmayer was negligent in failing to warn his guests to engage their parking brake when leaving their vehicle unattended on the sloping driveway.
She said she suffered blunt head trauma, a concussion, a cervical sprain and other injuries that have interfered with her ability to engage in everyday activities, including work. The suit filed in Lane County Circuit Court seeks $16,000 in medical expenses, $10,000 in lost earnings and $35,000 in non-economic damages.
Dave Frohnmayer did not respond to a message seeking his comment.
